The prime minister of our country spoke, that in the purport which he gives a press interview on the occasion of the Iraq military power attack by the United States, he gave supreme priority to the cooperation for U.S.. It has been supposed conventionally that Japan as a law-governed state is ruled under two laws which are contradictory. The one is the Constitution of Japan and the other is a security treaty between Japan and U.S.. Although the political world and academic circles have disputed about which is superior to another, the prime minister is interpreted as having brought to an end here now. That is, the constitutional government system of our country is under the fact that a security treaty has priority over the Constitution of Japan. Though the Constitution of Japan has declared clearly not using military power as a solution means of international disputes in and abroad, our prime minister declared that military power use was also unavoidable from the viewpoint of Japana-US cooperation. The following anxiety which has deepened about a security treaty since previously was brought near. It was about Japan "participating in the war" almost automatically to those wars which the United States began. As a result, it was anew proved also about this military power attack on Iraq that this anxiety is actual. They are the Korean War, the Vietnam War, the Gulf War, the Afghanistan war, and is this military power attack for Iraq this time. However, the doubt about the justification of this "participation in the war" deepened further about the attack on Iraq for the reason why no U.N. resolution of Security Council was based.
And wherever the Constitution of Japan and Japan-US Security Treaty may also read , we cannot hear about words or soul in any article which justify "a pre-emptive strike", either. That is, the war which were able to be begun lately and the support manifestation to the war, needless to say, may not be admitted with any laws which have governed Japan long since the end of the Paccific War

Eagerly please, I want the U.S. to stop this war immediately and Japan to ask for backing out of de facto "participation in the war" by the support to it for one day.

すべての友よ
我が国の首相は、アメリカによるイラク武力攻撃に際し、記者会見し、冒頭、対米協調をなによりも優先する旨、発言しました。従来法治国家としての日本は、二つの相矛盾する法の下に支配されているとされてきました。一つは日本国憲法であり、他の一つは安保条約であると。どちらが優越するのか政界、学界ともに論争のあるところでしたが、首相はここで決着をつけたと解釈されます。すなわち、我が国の法治システムは、日本国憲法よりも安保条約が優先するのだと。日本国憲法は、国際紛争の解決手段として武力を用いないことを明確に内外に宣言しているのに、首相は、日米協調の立場から、武力行使もやむを得ないと宣言したからです。
かねてから安保条約について深い憂慮が寄せられていました。それはアメリカが始めた戦争に対して、日本はほとんど自動的に「参戦」することになるということについてでした。今回の対イラク武力攻撃についても、あらためてこの憂慮が現実のものであることを実証する形となりました。朝鮮戦争、ベトナム戦争、湾岸戦争、アフガン戦争、そして今回の対イラク武力攻撃です。
しかし、対イラク攻撃について、安全保障理事会の国連決議をふまえなかったという点で、いっそうこの「参戦」の正当性についての疑惑が深まりました。
しかも、日本国憲法も日米安全保障条約のどこを読んでも、「先制攻撃」を正当化する文言も精神もうかがうことができません。つまり、この度始められた戦争とそれへの支持表明は、日本を支配するいかなる法をもってして容認され得ないものであることは言うまでもありません。
どうか一日も、一刻も早くこの戦争を停止し、それへの支持による事実上の「参戦」からも身を引くことを、日米両国に切に求めたいと思います。
